Nick has more than fifteen years of experience as a judicial clerk, in-house counsel and outside counsel. In that time, he has had experience in all phases of patent litigation, from pre-suit due diligence through appeals, and has represented both plaintiffs and defendants in patent disputes.  He has significant experience developing and implementing litigation strategy, negotiating settlements, and evaluating patent portfolios.

Nick’s practice specializes in patent litigation and portfolio assessment.

Prior to joining Feinberg Day, Nick clerked in the District of Delaware and worked as a patent litigator at three prominent law firms and as in-house counsel at Adobe Systems, Inc.

BioCardia v. Boston Scientific (N.D. Cal.) Represented BioCardia in a litigation involving breach of contract, trade secret misappropriation, and correction of inventorship.
Polaris v. Samsung (E.D. Texas) Represented plaintiff Polaris in a patent litigation involving automatic brightness control in electronic devices. Obtained a favorable settlement shortly before trial.
Velocity Patent v. Fiat-Chrysler America (N.D. Ill.) Represented plaintiff Velocity Patent in patent litigation involving fuel economy and safety features in automobiles.
Medtronic Sofamor Danek U.S.A. v. NuVasive, Inc. (S.D. Cal.) Represented defendant NuVasive in a patent litigation involving medical devices and surgical techniques.
In re Halftone Color Separations Patent Litigation (C.D. Cal.)  Represented defendant Adobe in a patent litigation relating to color printer software. Obtained a favorable settlement after a successful claim construction.
Multimedia Patent Trust v. Microsoft Corp. (S.D. Cal.) Represented defendant Microsoft in patent litigation involving video encoders.
Callaway Golf Co. v. Acushnet Co. (D. Del.) Represented plaintiff Callaway Golf in a patent litigation involving golf clubs and balls.
